Jokowi Officially Signs Law Number 2/2021 concerning Special Autonomy in Papua




President Joko Widodo (Jokowi) has officially signed Law No. 2/2021 on Papua's Special Autonomy. The law had previously been approved in the plenary session of the DPR.
Law Number 2 of 2021 concerning the Second Amendment to Law Number 21 of 2001 concerning Special Autonomy for the Papua Province was signed by President Jokowi on Monday (19/7/2021). A number of articles have changed from the previous rules.

One of the changes is Article 4. The following is complete:

Article 4
(1) The authority of the Papua Province includes authority in all areas of government, except for the authority in the fields of foreign policy, defense and security, monetary and fiscal, religion, and the judiciary as well as certain authorities in other fields as determined in accordance with the provisions of the legislation.
(2) In addition to the authority as referred to in paragraph (1), in the context of implementing Special Autonomy, the Papua Province and regencies/municipalities are given special powers based on this Law.
(3) The authority of the regency/municipality includes the authority as regulated in the statutory regulations.
(4) International agreements made by the Government which are only related to the interests of the Papua Province shall be implemented after receiving consideration from the Governor and in accordance with the provisions of the laws and regulations.
(5) Papua Province may enter into mutually beneficial cooperation with overseas institutions or agencies in accordance with the provisions of laws and regulations.
(6) The Governor coordinates with the Government in terms of the defense spatial policy in Papua Province.
(7) Provisions regarding the exercise of authority as referred to in paragraph (1) and paragraph (2) shall be regulated in a Government Regulation.
(8) Provisions regarding the procedure for giving consideration by the Governor as referred to in paragraph (4) shall be regulated by a Perdasus.

Article 76
(1) The division of provinces and regencies/municipalities into provinces and regencies/municipalities may be carried out with the approval of the MRP and DPRP after seriously paying attention to socio-cultural unity, readiness of human resources, economic capacity, and future developments. come.
(2) The Government and the House of Representatives may carry out the expansion of provincial areas and
regencies/cities become autonomous regions to accelerate equitable development, improve public services, and improve community welfare, as well as elevate the dignity of the Indigenous Papuans by taking into account the political, administrative, legal, socio-cultural aspects, readiness of human resources, basic infrastructure, capacity economy, future developments, and/or the aspirations of the Papuan people.
(3) The expansion of the provinces and districts/cities as referred to in paragraph (2) without
carried out through the regional preparatory stages as regulated in the Law concerning regional government.
(4) The expansion must guarantee and provide space for Papuan Indigenous People in political, governmental, economic, and socio-cultural activities.
(5) The establishment of an autonomous region shall be carried out in accordance with the provisions of this Law and shall be stipulated by law.

The previous government through the Coordinating Minister for Political, Legal and Security Affairs Mahfud Md had responded to the ratification of the revision of the Special Autonomy Law for Papua. Mahfud Md spoke about the management of funds, which was accompanied by the central government.

"The special autonomy fund will now be maximized for welfare in Papua. It will no longer be allowed to be managed without clear accountability, but will be accompanied by the center. The funds will be increased from 2 percent to two and a quarter percent of the national DAU (General Allocation Fund)," said Mahfud in his statement, Thursday (15/7).

Mahfud said the revision related to the validity period of the special autonomy fund which originally had to end in November 2021 was extended again until 2022. Mahfud also talked about the development of the issue of an independent Papua.

"Alhamdulillah, all of the foreign ambassadors confirmed that there is no longer an issue of an independent Papua, Vanuatu is still voicing that, but now the approach is no longer an independent Papua. The approach is how to resolve cases of human rights violations (human rights). "explained Mahfud.

His party, said Mahfud, is trying to resolve human rights cases in Papua. For him, there is a group of people who are trying to tarnish Indonesia's image by playing with issues surrounding human rights.

"We are solving and organizing the issue of human rights protection which has always been rumored by a small group of people who really want to make Indonesia's image bad.
